Terms and Conditions - Oameni

Last updated: 4 September 2026

These Terms and Conditions govern access to and use of the Oameni platform, available at oameni.org, app.oameni.org and through the Oameni mobile application for iOS and Android (the "Platform").

By creating an account, accessing the Platform, registering for an event, joining a community, purchasing a ticket or subscription, or using the mobile app, you confirm that you have read, understood and accepted these Terms, the Privacy Policy, any applicable event or community rules, and the mobile store terms that apply to your device.

1. Operator

The Platform is owned and operated by RedShift IT S.R.L., a company incorporated under Romanian law, with registered office in Romania, Bucharest, Str. Piscului no. 14, Bl. 47, Sc. A, Ap. 1, Sector 4, registered with the Bucharest Trade Registry under no. J40/5296/21.05.2010, tax identification code RO26963888, VAT payer.

Bank account: IBAN RO33BTRL04301202S92757XX, opened with Banca Transilvania.

In these Terms, "Oameni", "we", "us" and "our" mean RedShift IT S.R.L. and the Platform. "User" means any person using the Platform. "Organizer" or "Community Admin" means a user who creates, manages or moderates communities, events, memberships, payments or participant communications through the Platform.

2. What Oameni Does

Oameni provides software tools for real-life communities and offline events. The Platform allows users to discover communities and events, register for events, buy tickets or memberships, interact with participants, use chat and direct messaging, receive notifications, manage digital tickets and wallet passes, and manage account preferences.

Oameni provides technology infrastructure. Unless clearly stated otherwise for a specific Oameni-owned event, Oameni is not the organizer, host, venue operator, travel provider, security provider, medical provider or seller of the offline event experience itself. Organizers remain responsible for their own communities, events, venue choices, participant communications, eligibility criteria, refunds where they control the sale, and compliance with applicable local rules.

A community may opt into its own subdomain or custom domain (the "community portal") to present its page, events and subscriptions. A community's use of its own domain does not change the contractual relationship: these Terms, the Privacy Policy, and all provisions applicable to organizers remain fully in effect regardless of the domain or visual branding through which the Platform is accessed.

3. Eligibility and Account Rules

The minimum age to use the Platform is the age shown in the app store listing for your region (currently 16 in most countries, 15 in Brazil and South Korea), or the minimum legal age required in your jurisdiction if higher. By using the Platform you self-certify that you meet this age. You must provide accurate, current and complete information and keep your login credentials secure. You are responsible for actions performed through your account.

You must notify us immediately at [email protected] if you suspect unauthorized access, account takeover, security abuse or misuse of your account. We may suspend, restrict or terminate accounts that violate these Terms, applicable law, store policies, safety rules or community standards.

4. Mobile App, App Store and Google Play Terms

The mobile app is licensed, not sold. You may use it only for lawful personal or organizer purposes and only in accordance with these Terms, Apple App Store terms, Google Play terms, and any applicable end user license agreement shown by the store.

If you use iOS, Apple and its subsidiaries are third-party beneficiaries of the mobile app terms to the extent required by Apple. Apple is not responsible for providing maintenance or support for the Platform.

If a digital feature, subscription, membership, promotion, limit upgrade or other in-app digital benefit must be purchased through Apple In-App Purchase or Google Play Billing under store rules, the mobile app will use the relevant store billing system. Store billing terms, subscription management, cancellation flows and refund processes may apply in addition to these Terms. We do not control Apple or Google refund decisions.

For purchases made through Apple In-App Purchase or Google Play Billing, only Apple or Google can approve and process the refund — Oameni cannot issue that refund directly, and we update payment status and access only after the store confirms the outcome. If you turn on “Share purchase activity with Apple to help resolve refund requests” in Account settings, we share limited, factual details about a specific transaction with Apple after you request a refund directly from Apple, solely to help Apple resolve that request; this has no effect on purchases made on the website.

Physical or offline services, including event attendance at a real-world venue, may be paid outside in-app billing where store rules allow it. We may change mobile purchase flows to comply with Apple, Google or applicable law.

5. Communities and Organizer Responsibilities

Organizers may create communities, configure memberships, publish pages, announcements, galleries, albums, polls, join questions, events, tickets, discounts, vouchers, visibility settings, chat settings, email or messaging settings, and moderation workflows.

Organizers must: (a) provide truthful information; (b) comply with Romanian, EU and local laws; (c) respect consumer protection, privacy, anti-discrimination, tax and invoicing rules; (d) clearly disclose prices, cancellation rules, access conditions and eligibility criteria; (e) process participant data only for legitimate community or event purposes; (f) not use the Platform for fraud, spam, harassment or illegal activity; and (g) respond responsibly to reports and safety concerns.

Public visibility of a community or event is not automatic. It may require Platform review and approval before it becomes visible to others or listed publicly. We take inspiration from the conduct standards used by comparable social networks and from the user-generated content policies required by the Apple App Store Review Guidelines (sections 1.1, 1.2 and 1.4.3) and the Google Play Developer Program Policies. We may reject an approval request, or later hide, suspend, remove or restrict a community, an event, an account or a feature, when we find any of the following, whether or not it was flagged through a report:

Illegal content or content endangering physical safety — incitement to violence, dangerous organizations or individuals, terrorism, human trafficking, weapons, illegal drugs, activities that put attendees at real physical risk without warning and informed consent.

Exploitation, abuse, or content endangering minors — any sexual content involving minors, grooming, facilitating unauthorized contact with minors, events or communities that cannot reasonably verify the minimum attendee age where the content requires it.

Explicit sexual or exploitative content — pornography, soliciting paid sexual services, nudity without a clearly stated artistic, educational or medical purpose.

Hate, discrimination and harassment — content or admission rules that incite hatred or discriminate on the basis of race, ethnicity, nationality, religion, disability, gender, gender identity, sexual orientation or age, other than eligibility criteria legally permitted for certain communities (e.g. support groups, legally permitted gender-specific communities).

Partisan political activity, extremism, and high organizational-risk groups — communities or events organized by, affiliated with, or used for the electoral campaign of a political party, political organization, electoral alliance, or any associated structure (branches, youth wings, groups with a declared electoral purpose); communities or events that promote, recruit for, or glorify extremist ideologies or militant movements of any orientation (extremist nationalism based on ethnicity or national identity, religious extremism, militant anarchism advocating the destruction of public order or violence against institutions, violent separatist movements, unauthorized paramilitary groups); cults or religious movements practicing recruitment, coercive control, or isolating members from family and society; organized-crime-affiliated groups, including those using gang codes, colors, or symbols to signal membership; communities, "supporter galleries" or fan groups associated with violence, hooliganism, planned confrontations with rival supporter groups, use of pyrotechnics banned at venues, or bringing weapons or dangerous objects to sporting events.

Hostile militancy in any form — regardless of the declared cause, identity or ideology (political, religious, ethnic, national, gender, sexual orientation or otherwise), communities or events whose actual activity consists, in whole or in part, of organizing hostility, exclusion, harassment, confrontation or incitement to hatred against another group are prohibited.

Advocacy and activism as the primary purpose — regardless of cause, direction or ideology (political, religious, social, environmental, identity-based or otherwise), the Platform is intended for communities and events built around shared interests, hobbies, social, professional, cultural, educational or recreational activities — not for organizing, promoting or mobilizing support for a cause, movement or advocacy agenda. Communities or events whose primary activity is activism, awareness campaigns, petitions, political or social mobilization, lobbying, or promoting an ideological agenda, regardless of direction, are not permitted on the Platform. The following remain permitted: mutual support groups and communities defined by identity, belief, origin, religion, sexual orientation or gender identity, as long as their activity consists of meetings, mutual support and socializing among members, not campaigns or external mobilization; and fundraising events with a verifiable humanitarian or medical purpose (e.g. medical treatment, disaster relief, blood donation) that do not promote an ideological agenda.

Fraud, deception and financial schemes — pyramid schemes, unauthorized multi-level marketing, false financial promises, fundraising without a verifiable stated purpose, sale of legally prohibited products or services.

Impersonation and authenticity — profiles, communities or events that falsely claim official affiliation, use another person's or organization's identity without right, or mislead about the organizer or the true nature of the event.

Intellectual property infringement — unauthorized use of a third party's protected name, trademark, logo or content.

Regulated goods and services — sale or promotion of alcohol, tobacco, heated tobacco products, weapons, gambling or financial services without the licenses or authorizations required by applicable Romanian or EU law.

Spam and platform manipulation — mass-created or duplicate communities or events, used to manipulate rankings, reviews, or the distribution of unsolicited content.

Non-compliance with mobile store policies — any content or behavior that Apple or Google classifies as unacceptable for an app distributed through the App Store or Google Play, including where the non-compliance concerns only part of a community or a single event.

Repeated non-compliance with the community's or event's own rules — organizers who fail to enforce or follow their own community's published rules, or who repeatedly ignore reports they receive.

A rejection or restriction decision is communicated to the organizer, together with the general reason for the decision, unless the law or the need to protect a safety investigation prevents this. The organizer may appeal the decision under the procedure in section 10.

Invitations and messages sent to other people. The Platform lets you send invitations to your community or event, one by one or in bulk, by email, WhatsApp or in-app notification. When you use this feature, you agree to follow the rules below.

Consent before you invite — before sending an invitation, you must have a legal basis to use each person's email address or phone number and, where the law requires it (in particular Regulation (EU) 2016/679 – GDPR and Romanian Law no. 506/2004 on electronic communications), that person's prior, freely given consent, which you can prove. The box you confirm in the Platform before sending is your own declaration: it does not replace your obligation to be able to prove consent.

The data you upload is your responsibility — toward the people you invite, you decide whom to contact and you are responsible for the lists, CSV files, email addresses and phone numbers you enter. The Platform is only the tool that delivers the message; it cannot verify whether you have people's consent and is not liable for invitations sent without consent or without another legal basis.

No spam — you must not send invitations to purchased, rented, scraped or otherwise obtained-without-consent lists, repeatedly send the same message to the same people, hide who is sending it, or use invitations for advertising unrelated to your community or event.

Unsubscribing and refusals — honor immediately any request to stop receiving invitations, whether it comes through the unsubscribe link in the email, a STOP reply on WhatsApp, or directly to you. The Platform stops sending to unsubscribed addresses, but you remain responsible for not contacting them through other channels.

Proof of consent — keep proof of consent for as long as you send invitations and make it available to us or to the authorities if we ask. For each invitation, the Platform records the account that sent it and when you confirmed consent, for checks and complaints.

Consequences — sending invitations without consent or for spam is a serious breach of these Terms. We may limit or disable the invitation feature, stop messages that are still pending, and suspend the community, the event or the account, under sections 5 and 10.

6. Events, Attendance and Offline Safety

Events may be public, hidden, private, members-only, code-protected, ticketed, free, waitlisted, capacity-limited, gender-balanced, guest-enabled or subject to organizer approval. Organizers may set registration questions, arrival windows, guest limits, special codes, vouchers, reserved seats and attendance rules.

Offline events involve real-world risks. You are responsible for your own safety, travel, conduct and decisions when attending an event. We do not guarantee the identity, background, behavior, health, safety or suitability of any user, organizer, venue or third party. If you face immediate danger, contact local emergency services first.

Organizers may approve, reject, cancel, waitlist, remove or check in participants according to published rules and applicable law. Participants must respect venue rules, organizer instructions, community standards and applicable law.

An individual event may be rejected, hidden or suspended for the same reasons applicable to communities under section 5, as well as where: the event's description or images mislead as to its true nature, price or location; the event solicits payments outside the payment flows permitted by the Platform or by mobile store rules for digital content; the event takes place at a venue that fails to meet minimum safety or legal requirements known to the Platform; or the organizer has repeatedly cancelled approved events without reasonable notice to attendees.

7. Registration Data and Custom Questions

Default account registration requires name and email. Depending on the event or community, organizers may require phone number, date of birth, gender, social profile link, billing details, guest details, arrival time, membership answers, custom question answers, or other information reasonably related to participant selection, safety, event logistics, invoicing or community management.

You must not submit false, misleading or third-party personal data without authority. If you provide guest data or invite another person, you confirm that you have permission to provide that information and that the person understands it may be used for event administration.

8. Payments, Tickets, Subscriptions, IAP and Refunds

Events, memberships, platform subscriptions, community subscriptions, promotions, limit upgrades and other products may be free or paid. Prices, VAT treatment, currency, billing profile, payment provider, renewal terms, cancellation options and refund rules may vary by product type and by organizer.

Payments may be processed by Stripe, Apple, Google, banks, card networks or other payment providers. We do not store full card numbers. For invoices and fiscal documents, we may use Oblio or other invoicing providers. Where a community has its own billing profile, that community may be the seller/invoice issuer for its tickets or member subscriptions; otherwise the platform billing profile may apply. Before you complete a payment, we show you the seller's identity and applicable tax ID, where available.

Tickets may be issued as PNG, QR/code-based records, Apple Wallet passes, Google Wallet passes or other digital formats. A ticket or membership pass may be regenerated, invalidated or refused if it is fraudulent, duplicated, refunded, cancelled, expired, transferred without permission, or used contrary to event rules.

Subscriptions may renew automatically unless cancelled through the place where they were purchased: Oameni account, Stripe checkout/customer portal, Apple account settings or Google Play subscription settings. Upgrade, downgrade and cancellation timing may depend on the payment provider and store rules.

Refunds depend on the product, payment provider, organizer rules, store rules and mandatory consumer law. For leisure services linked to a specific date or period, statutory withdrawal rights may be limited or excluded under Romanian and EU consumer rules. For digital content or services delivered immediately after purchase, withdrawal rights may also be limited where the law allows and the user has requested immediate performance. For digital subscriptions purchased directly on the website (not via App Store/Google Play), we ask for a separate confirmation, distinct from accepting the Terms, where you expressly state that you want the service to start immediately and that, as a result, you waive the 14-day withdrawal right. Nothing in these Terms limits mandatory consumer rights.

Chargebacks, refunds or payment failures may lead to ticket cancellation, subscription suspension, benefit removal, invoice correction, storno invoice or payout adjustment.

Suspension or removal for violations. If we suspend, restrict or remove an account, a community, an event, a subscription, a ticket or any other paid feature because you, your community, or associated content violated these Terms, the applicable community or event rules, applicable law, or mobile store policies, the suspension, restriction or removal may be immediate, as described in section 10. For serious or repeated violations, we owe no refund, credit, compensation or damages for the remaining period, unused paid features, the discontinued subscription, or lost benefits, even if the amount was already paid in full. For a single, minor violation that did not require permanent removal, you will receive a refund proportional to the unused remaining period, unless the law, mobile store rules, or the nature of the product (for example, a ticket already used at the event) excludes this. This rule applies both to organizers and community admins, and to participating users who purchased an event ticket (physical or online) or a community subscription and violated the applicable rules. This does not limit your statutory right to a refund where the suspension or removal is later found to be unjustified, or any other mandatory right that consumer protection law does not allow to be excluded by contract. Refunds for purchases processed through Apple In-App Purchase or Google Play Billing remain, in any case, at the discretion of Apple or Google under their own policies.

Buying a plan, an upgrade or a promotion entitles you to submit a request for publication, public listing or promotion, but does not guarantee that it will be approved. The refund terms where such a request is rejected are set out in section 15.4.

9. Acceptable Use and User-Generated Content

The Platform includes user-generated content such as profiles, avatars, event descriptions, community pages, announcements, galleries, albums, polls, chat messages, direct messages, ratings, notes, reports, comments, registration answers and uploaded media.

You must not upload, publish, send or facilitate content or behavior that is illegal, fraudulent, hateful, discriminatory, sexually explicit, exploitative, violent, threatening, abusive, harassing, defamatory, privacy-invasive, misleading, infringing, spammy, malware-related, or otherwise objectionable. You must not impersonate others, scrape the Platform, bypass security, manipulate payments or ratings, resell tickets without permission, or use the Platform to facilitate harm.

Content involving pornography, sexual exploitation, human trafficking, illegal drugs, weapons, violence, threats, bullying, harassment, scams, hate speech or content that endangers minors is prohibited and may lead to immediate removal and account termination.

In addition to the above, the following categories of content are always prohibited on the Platform, regardless of community or event context: content promoting self-harm or suicide without associated help resources; content promoting eating disorders; deepfakes or artificially generated content presented as genuine in order to mislead; doxxing or publishing a person's private data without consent; content facilitating the sale of firearms, ammunition, explosives or lethal weapons prohibited to the general public; content promoting or facilitating illegal drug use; and any content that would classify the mobile app as objectionable under Apple App Store Review Guidelines section 1.1 (Objectionable Content) or Google Play's Restricted Content policies.

10. Reporting, Blocking, Moderation and Appeals

We provide tools to report users, events, communities, chat messages and community-generated content, and to block abusive users where available. Reports may be reviewed by community admins, platform admins or automated safety tools.

Moderation actions may include warning, content hiding, content removal, report dismissal, account restriction, account suspension, community removal, event access revocation, membership removal, chat restriction, payment feature restriction or referral to competent authorities. Some content may be automatically hidden when reporting thresholds or safety settings are met, especially for private communities or reported content awaiting review.

A violation of any provision of these Terms, of the applicable community or event rules, or of applicable law may lead directly to the immediate suspension, restriction or removal, without prior warning, of the account, community or event through which the violation was committed — not only in cases of repeated or serious violations — where we consider this necessary for attendee safety, legal compliance, or compliance with mobile store policies.

If your content, event, community, payment feature or account is restricted, you may contact [email protected] to request review. Include account email, affected content or event/community link, decision received and reason for appeal. We will review appeals in a reasonable time, taking into account safety, legal obligations, evidence, organizer responsibilities and platform integrity. This is our internal complaint-handling system under Art. 20 of the EU Digital Services Act (DSA); we keep records of the decision and appeal for at least 6 months.

For notices of illegal content under EU Digital Services Act principles, send a sufficiently substantiated notice to [email protected] with: exact URL or identifier, explanation of illegality, your contact details, statement of good faith and any supporting evidence. We may ask for more information if the notice is incomplete.

11. Privacy and Data Protection

Personal data is processed as described in the Privacy Policy. By using the Platform, you understand that your data may be processed for account management, event registration, community administration, payments, invoicing, messaging, notifications, moderation, analytics, fraud prevention, security and legal compliance.

Organizers may receive participant data needed for events or communities. They must use it lawfully and only for the relevant community or event purpose.

12. Intellectual Property

The Platform, software, design, logos, trademarks, code, databases and related materials belong to RedShift IT S.R.L. or its licensors. You may not copy, reverse engineer, misuse or commercially exploit them without permission.

You retain ownership of your own content. You grant Oameni a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, transmit, moderate, adapt for technical formatting, translate where needed, and process your content only as necessary to operate, secure, promote and improve the Platform and provide the features you use.

13. Third-Party Services

The Platform may integrate with Stripe, Apple, Google, Oblio, email providers, push notification providers, hosting providers, analytics providers, maps, storage, WhatsApp or other third-party services. Their own terms and privacy policies may apply. We are not responsible for third-party systems outside our control.

Some features available through a platform or community subscription rely on integration with third-party services such as WhatsApp Business (Meta), SMTP email providers, Stripe, or Oblio. The subscription covers the cost of developing, maintaining and providing technical access to that integration within the Platform, not the actual cost of using the third-party service. The fact that a feature (for example, WhatsApp messaging, email sending through your own SMTP provider, payment processing through Stripe, or invoice issuance through Oblio) is listed as available in a subscription plan does not mean that usage is prepaid or included at no additional cost. The costs of using the third-party service — for example, Meta's per-conversation WhatsApp fees, Stripe processing fees, your own SMTP provider's costs, or Oblio's invoice-issuance costs above its free tier — remain the sole responsibility of the organizer or community using that feature, under the pricing and terms set directly by that third-party provider. The organizer is responsible for setting up and maintaining their own accounts and credentials with these providers where a feature requires it, and for complying with those providers' own terms and usage policies.

14. Availability, Changes and Security

We try to keep the Platform available and secure, but we do not guarantee uninterrupted access, error-free operation, permanent availability of any feature, or compatibility with every device. We may modify, suspend or discontinue features for maintenance, security, legal, store-policy or business reasons.

The Platform is provided “as is” and “as available”. We offer no service level agreement (SLA) and we do not guarantee any minimum uptime percentage, response time, time to fix, or absence of defects. Like any software, the Platform may contain programming errors, defects, incompatibilities or unexpected behaviour, including after updates, and we fix them at the pace and in the order we determine. The subscription plans published on the Platform do not include an SLA; such a commitment exists only where we have expressly agreed to it in a separate written contract signed by us.

Unavailability means a period during which the core functions of the Platform cannot be used at all, for reasons within our direct technical control, including a software defect of the Platform. The following are not unavailability and are not counted: planned maintenance announced at least 24 hours in advance; urgent security updates; partial performance degradation; the unavailability of a single ancillary feature; measures taken under sections 5, 9, 10 or 16; fortuitous events and force majeure within the meaning of Article 1351 of the Romanian Civil Code; failures, decisions or outages of the third-party providers listed in section 13 (including Stripe, Apple, Google, Meta/WhatsApp, Oblio, and our email, hosting, CDN or DNS providers); problems with your network, device, browser or connection; and any use of the Platform contrary to these Terms, including excessive automated requests.

15. Limitation of Liability

15.1. General exclusions. To the maximum extent permitted by law, Oameni is not liable for indirect damages, loss of profit, lost revenue, loss of a chance, loss or corruption of data where you were able to keep your own copy, reputational harm, disputes between users and organizers, organizer decisions, event cancellations, venue issues, offline incidents, app store or payment provider decisions, temporary service interruptions, software defects, or user-generated content.

15.2. Platform unavailability — cap and calculation. If the Platform was unavailable within the meaning of section 14, the only contractual remedy we owe is a limited monetary compensation, calculated as C = A × (H / T), where A is the net-of-VAT amount of your subscription for the calendar month in which the unavailability occurred (for annual subscriptions, A is one twelfth of the annual net price), H is the number of whole hours of confirmed unavailability in that month, and T is the total number of hours in that calendar month.

The compensation so calculated may never exceed A — that is, the subscription amount paid for the month in which the unavailability occurred. If you use the Platform free of charge, or you paid no subscription for that month, we owe no monetary compensation for unavailability. Compensation is calculated separately for each calendar month and does not carry over.

15.3. How to claim. Send your claim to [email protected] within 30 days of the end of the calendar month in which the unavailability occurred, stating the dates, time ranges and features affected. We verify the claim against our own logs and monitoring, which are evidence of the duration of the unavailability unless the contrary is proven. Compensation is provided either as a refund through the original payment method or as a reduction of the invoice for the next subscription period — at your choice if you are a consumer, and at our choice otherwise.

15.4. Publication, listing or promotion requests that are not approved. Buying a subscription, a plan upgrade, a limit upgrade or a promotion entitles you to submit a request for public visibility, listing or promotion — it does not constitute and does not guarantee approval of that request. Approval is a moderation decision, made on the criteria set out in sections 5, 6 and 9, and this is made known to you before purchase. We give you the reasons for a rejection, and you may appeal under section 10.

If you bought a subscription or a plan upgrade solely in order to submit such a request, and the request is rejected:

(a) for reasons not attributable to you — for example a technical limitation of the Platform, an error on our side, or a change in our policy occurring after your purchase — we refund in full the amount paid for that subscription, upgrade or promotion, or the price difference against your previous plan. If in the meantime you also used other paid features of the plan, the refund is proportional to the remaining unused period.

(b) for reasons attributable to you — your content, community, event or account does not comply with sections 5, 6 or 9, with the applicable rules or with the law — we owe no refund, credit, compensation or damages, and the price remains due for the subscription period actually made available to you. If, following the appeal under section 10, the rejection turns out to have been unjustified, point (a) applies.

In all cases, our liability in connection with a rejected publication, listing or promotion request is limited to the amount actually paid for the subscription, upgrade or promotion concerned, and does not extend to lost revenue, organising costs, marketing or advertising spend, venue deposits and bookings, contractor fees or other related losses.

15.5. Overall cap. Except in the situations set out in 15.7, our total aggregate liability to you, for all claims arising out of or in connection with the Platform and these Terms, on any legal basis, may not exceed the total amount you actually paid to Oameni in the 12 months preceding the event giving rise to the damage. If you made no payment to Oameni in that period, we owe no monetary compensation under these Terms, other than what mandatory law requires under 15.7.

15.6. Business users. If you use the Platform for professional purposes — as an organizer, community administrator, company, sole trader or other professional within the meaning of Article 3(2) of the Romanian Civil Code — the caps in 15.2, 15.4 and 15.5 apply in full. They reflect the economic balance of a service offered at the published prices, the availability of free plans, and the fact that the revenue from your events and communities does not accrue to us.

15.7. Mandatory limits. Nothing in these Terms excludes or limits: liability for material damage caused intentionally or through gross negligence (Article 1355(1) of the Romanian Civil Code); liability for harm to life, physical or mental integrity, or health (Article 1355(3) of the Romanian Civil Code); rights that consumer protection law does not allow to be excluded by contract, including the remedies for lack of conformity of digital content and digital services under Romanian GEO no. 141/2021, which transposes Directive (EU) 2019/770, and the rights under Romanian GEO no. 34/2014, which transposes Directive 2011/83/EU; and any other liability that cannot be limited under mandatory Romanian or European law.

If you are a consumer, the caps in 15.2, 15.4 and 15.5 apply only to the extent permitted by law and do not restrict your right to have the digital service brought into conformity, to an appropriate price reduction, or to terminate the contract where the digital service is not in conformity, nor your right to turn to ANPC or to the competent courts under section 18. This section is to be read so as not to create a significant imbalance in the parties’ rights and obligations within the meaning of Romanian Law no. 193/2000; if part of a clause is found unfair or void, the rest of this section continues to apply.

15.8. Purchases through the mobile stores. For purchases processed through Apple In-App Purchase or Google Play Billing, refunds remain at the discretion of Apple or Google under their own policies, and any compensation we grant under this section is reduced by any amount you have already received from the store for the same period.

16. Termination and Account Deletion

You may request account deletion from your account. Deletion may include a restore grace period, after which data is deleted or anonymized except where retention is required for invoices, legal obligations, security, fraud prevention, dispute handling or legitimate platform records.

We may suspend or terminate access if you breach these Terms, create risk, violate law, violate store rules, abuse users or systems, or create liability for Oameni, organizers or other users.

17. Changes to Terms

We may update these Terms. Material changes may require renewed acceptance in the app or on the website. Continued use after publication or acceptance means you agree to the updated Terms. We may keep technical records of the version accepted, timestamp and related page identifier. For material changes that negatively affect an active subscription, we will notify you at least 15 days before they take effect; you may cancel without penalty until then.

18. Governing Law and Jurisdiction

These Terms are governed by Romanian law and applicable European Union law. Disputes shall be resolved by the competent Romanian courts, unless mandatory consumer law grants you the right to bring claims elsewhere or provides stronger protection.

If you are a consumer, you may also file a complaint via the EU Online Dispute Resolution (ODR) platform, available at ec.europa.eu/consumers/odr, or contact your national consumer protection authority.

19. Contact

For legal, privacy, moderation, billing, refund or support matters, contact us at [email protected].

20. Apple App Store Additional Terms

This section applies when you download or use the app through the Apple App Store. These terms supplement the Oameni Terms and Conditions; in case of conflict, this section prevails only to the extent necessary for use of the app through the Apple App Store.

Scope of licence. Oameni grants you a non-transferable licence to use the app on Apple-branded products that you own or control, subject to the Apple Media Services Usage Rules.

Maintenance and support. Oameni, not Apple, is responsible for providing maintenance and support services for the app to the extent required by law or provided by Oameni.

Warranty. If the app fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app, if any. To the maximum extent permitted by law, Apple has no other warranty obligation; any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform are Oameni's responsibility to the extent provided by these Terms and applicable law.

Product claims. Oameni, not Apple, is responsible for addressing any claims by you or a third party relating to the app or your possession and use of it, including product-liability claims, claims that the app fails to conform to applicable legal or regulatory requirements, and claims arising under consumer protection, privacy or similar legislation.

Intellectual-property rights. If a third party claims that the app or your possession and use of it infringes that third party's intellectual-property rights, Oameni, not Apple, is responsible for investigating, defending, settling and discharging that claim.

Eligibility and restrictions. You represent that you are not located in a country subject to a United States Government embargo or designated by the United States Government as a terrorist-supporting country, and that you are not listed on any United States Government list of prohibited or restricted parties.

Contact details. For questions, complaints or claims regarding the app, contact Oameni at [email protected] .

Third-party terms. You must comply with applicable third-party terms when using the app. Apple is not responsible for your compliance with applicable third-party terms.

Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of this section. Upon your acceptance of these Terms, Apple will have the right to enforce this section against you as a third-party beneficiary.

21. Authentication, Communication and Payment Services

Apple, Google, Facebook, Instagram, Meta/WhatsApp, Stripe, Stripe Connect, Firebase and Google Analytics may have their own terms and policies. Using them through the Platform gives you no rights in those services and you must comply with their applicable terms. Data processed and control options are described in the Privacy Policy.

If an organizer connects a Stripe Connect account, the organizer must accept the Stripe service agreement presented in the Stripe flow and provide accurate individual or entity information. Stripe may require KYC checks, payout information and documents. For each payment, the Platform and checkout flow must clearly identify the applicable seller/merchant of record; that party is responsible for the goods or services sold and for applicable disputes and refunds.

WhatsApp functionality may be used only for communications permitted by law, Meta/WhatsApp rules and required consent or opt-in. Users can stop communications from a community with STOP and reactivate them with START, where the feature is available.
